Participating restaurants, cafes and shops may withdraw the offers appearing on www.vouchergallery.com or change the terms and conditions or availability of the offers that we advertise at short notice at any time after you order a Card. We shall have no responsibility for any such withdrawals by participating restaurants, cafes and shops or changes in their terms and conditions or offer availability. In purchasing the Card you accept that we have no liability for any loss you suffer as a result of any refusal, cancellation or withdrawal of any offer by participating restaurants, cafes and shops or any failure or inability by you to take advantage of an offer for any reason.
Please read the following Terms and Conditions carefully. They contain important information about your rights and obligations. We recommend you keep these Terms and Conditions and (if this is not in hard copy form) you print out these Terms and Conditions from www.vouchergallery.com (the “Site”) by clicking on the print icon on your browser, and keep them for your future reference.
1.About us and these Terms and Conditions
1.1"We" or "us" are AHS Media, trading as ‘The Voucher Gallery’ of Winston House 349 Regents Park Road Finchley London N3 1DH. If you have any comments or suggestions, we would be pleased to receive them at our main address or by emailing us at marketing@thevouchergallery.com.
1.2These Terms and Conditions govern the supply by us of ‘The Voucher Gallery’ discount card (the “Card”) ordered by you, whether on the Site or by telephoning us on 07977 598595. Further details of the Card can be obtained by reviewing the Site or by reviewing any advertising or marketing materials that we may use from time to time. By agreeing to order a Card, you agree to be legally bound by the latest version of these Terms and Conditions.
1.3In these Terms and Conditions:
1.3.1a "Business Day" means a day which is not (a) a Saturday or Sunday, (b) a public holiday anywhere in the United Kingdom, or (c) any Jewish Holy day on which Jewish law forbids work;
1.3.2the "Contract" means your order of a Card in accordance with these Terms and Conditions which we have accepted in accordance with clause 2.8 below; and
1.3.3"you" means the customer who orders a Card from us, whose details are more particularly set out on the Site.
2.Making an order
2.1To make an order for a Card, you must be:
2.1.1over the age of 18; and
2.1.2resident in the United Kingdom.
2.2You may order a Card in the following ways:
2.2.1on the Site, by following the instructions on the Site as to how to make your order and for making changes to your order before you submit it to us; or
2.2.2by phone, by contacting us on the phone number given in clause 1.2 above and providing the information requested before submitting the order.
2.3The fee that you must pay to purchase a Card is £70 unless that fee is subject to a temporary special offer. We are not registered for VAT.
2.4When you order the Card on the Site:
2.4.1you shall pay for the Card at the time of ordering by using the Paypal payment method provided on the Site or by such other payment methods as we may offer from time to time, such as debit or credit cards. We require payment before processing your order for a Card, and we may obtain the money for payment of the Card before we have accepted your order;
2.4.2if you are asked for details of a payment card, you must be fully entitled to use that payment card. The payment card must have sufficient funds to cover the proposed payment to us; and
2.4.3you undertake that all details you provide to us for the purpose of purchasing the Card from us will be correct, that Paypal, credit or debit card, or other payment method, which you use is your own and that there are sufficient funds or credit facilities to cover the cost of the Card. We reserve the right to obtain validation of your credit or debit card details before supplying the Card.
2.5When you order a Card by phone, you shall pay for the Card at the time of delivery by cash or cheque, or by such other means as we may offer from time to time.
2.6When you submit an order to purchase a Card from us, you agree that you do so subject to these Terms and Conditions.
2.7Your order remains valid as an offer until we accept your order under clause 2.8 below or if earlier when we receive your notice revoking your order.
2.8We shall not be obliged to supply the Card to you until we have accepted your order. Unless expressly stating that we accept your order, an e-mail, letter, fax or other acknowledgement of your order by us is purely for information purposes and does not constitute acceptance of your order. We may in our discretion refuse to accept an order from you for any reason.
2.9The Contract shall be formed and we shall be legally bound to supply the Card to you when we accept your order. Unless we expressly accept your order by e-mail, letter or fax to you, acceptance shall take place when we despatch delivery the Card to you if you order on the Site, or when we deliver the Card to you if you order by phone.
2.10By ordering the Card on the Site or receiving delivery of the Card if you have ordered by phone, you acknowledge that you have read these Terms and Conditions and that you are bound by them.
2.11Until the time when we accept your order, we reserve the right to refuse to process your order, and you reserve the right to cancel your order, by notifying the other. If we or you have cancelled your order before we have accepted it, then we will promptly refund any payment made by you or your credit or debit card company to us for the order of the Card.
3.Delivery of the Card
3.1If you make your order for the Card online, we will aim to send the Card to you within three Business Days of receiving your order or your renewal date.If in the Hendon and Golders Green area we will endeavour to deliver next day except where there will be the Sabbath,Festival Day,Bank Holiday or other non working day. We will send the Card to you at the place of delivery requested by you when you make your order.
3.2If you make your order for the Card by phone, we will arrange a time and place for delivery to you by us at the time you make your order.
3.3We shall aim to let you know if we expect that we are unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
3.4Please note that it might not be possible for us to deliver to some locations. If this is the case, we will inform you using your contact details and arrange for cancellation of your order or an alternative delivery address.
3.5You must take care when opening the package containing the Card so as not to damage it, particularly when using any sharp instruments.
3.6If you are not available to take delivery or collection, we may leave a leaflet giving instructions on either redelivery or collection from us.
3.7You shall own the Card on the later of when we deliver it to you and when we receive payment in full for the Card (including VAT where applicable and any delivery charges).
3.8It is your responsibility to ensure that the Card is sufficient and suitable for your purposes and meets your individual requirements. We do not warrant that the Card or any goods and services provided by Participants (as defined in clause 5.1 below) will meet your individual requirements. You acknowledge that the Card is standard and not made bespoke to fit any particular requirements that you may have.
4.Cancellation
4.1If you make an order online for a Card, you may cancel your order and return the Card to us within seven Business Days of you receiving the Card. If you wish to cancel the order and return the Card to us please contact us at the contact details at clause 1.1 above and we will advise you of our requirements for returning the Card. You shall be responsible for any costs involved in returning the Card to us.
4.2If you make an order by phone and we deliver the Card to you in person, you shall not have the right to cancellation or refund set out in clause 4.1 above.
5.Use of the Card
5.1The Card must be presented at participating restaurants, cafes and shops (“Participants”) for goods and services in order to receive the offers available to holders of the Card.
5.2We will use our reasonable endeavours to update the Site to show the current up-to-date offers that are available with the Card. However, Participants may withdraw the offers appearing on the Site or change the terms and conditions or availability of the offers that we advertise at short notice at any time after you order a Card. We shall have no responsibility for any such withdrawals by Participants or changes in their terms and conditions or offer availability. In purchasing the Card you accept that we have no liability for any loss suffered by any legitimate holder of a Card or anybody connected with them as a result of any refusal, cancellation or withdrawal of any offer by a Participant or any failure or inability by a legitimate holder of a Card to take advantage of an offer for any reason.
5.3The information on the Site is for information purposes only. We do not warrant as to the accuracy or reliability of that information at any time. We shall not be liable for any losses arising out of reliance on information contained on the Site.
5.4We have no responsibility for the offers, products or services provided to you by Participants or the standard or quality of such provision.
5.5(a)Use of the Card is non-transferrable. The Card will have a name to identify you printed on it, and Participants may ask for proof of identification in order for you to use the Card. If we are provided with any evidence of Card sharing by you, we reserve the right to immediately cancel your Card.
5.5(b)Using an expired card intentionally. Retailers have the right to confiscate the card if there is evidence of presenting the card after the expiry date with intent to deceive. For example covering over the expiry date on presentation or clear amendments made to the original expiry date.
5.6We may offer links on the Site through to the websites or material of our Participants. We are not responsible for the content of any such website or material you may link to through the Site.
5.7In any event, if, for whatever reason, we do have any liability, our aggregate liability in relation to any Card is limited to a maximum of the amount payable in respect of that Card. Also, we shall have no liability in respect of any: (i) indirect or consequential losses, damages, costs or expenses; (ii) loss of actual or anticipated profits; (iii) loss of contracts; (iv) loss of use of money; (v) loss of anticipated savings; (vi) loss of revenue; (vii) loss of goodwill; (viii) loss of reputation; (ix) loss of business; or (x) loss of opportunity; whether or not such losses were reasonably foreseeable, known, foreseen or otherwise. We do not exclude or limit our liability for fraud, death or personal injury due to negligence, or any other liability which cannot be excluded or limit by law.
6.Additional Cards
6.1Additional Cards for use by a person in the same household as you may be ordered for an additional payment to us of £10.
6.2If you purchase a Card for use by your business, you may order additional Cards for use by other members of your business for an additional £10 for each additional Card ordered.
6.3If you have lost your Card, you should contact us immediately. You may order a replacement Card for an additional payment to us of £10.
7.Term
7.1Each Card that you order shall be valid for 12 months from the date on which you order it. The expiry date shall be printed on your Card.
7.2If you would like to renew your Card for an additional 12 months after it expires, you should contact us or visit the Site. We may contact you when your Card is approaching expiry to remind you to renew it, but it is your responsibility to ensure that you renew it prior to expiry.
7.3If your Card has expired, you will not be able to use your Card with Participants. You must surrender your expired Card to us if we so demand.
7.4If you breach any provision of these Terms and Conditions, you must surrender your Card to us if we so demand.
8.Amendment
8.1We reserve the right to amend these Terms and Conditions at any time. All amendments to these Terms and Conditions will be posted on-line and, if you have provided us with your email address, we will notify you of any amendment by email.
9.Circumstances beyond our control
9.1We shall not be liable for any delay, hindrance to us or failure to deliver due to any circumstances outside our reasonable control, including without limitation Acts of God, civil commotion, riots, revolt, war, terrorism, hostilities, warlike operations, piracy, arrests, restraints or detainments of any competent authority, strikes, lock-outs, floods, droughts, fire, earthquakes, mechanical breakdown, inability to obtain or shortage of materials, equipment or transportation or any legislation change.
10.Notices and contact details
10.1Subject to the rest of these Terms and Conditions, any notice or other communication required or authorised to be given under the Contract shall be in writing and shall be deemed to have been served only when actually received by the other.
10.2If we need to contact you for any other reason, we shall use the contact details that you provide to us when you order a Card. If these contact details change, it is your responsibility to inform us of that change.
11.General
11.1We shall keep a record of your order and these Terms and Conditions until six years after we have accepted your order. However, for your future reference, we advise you to print and keep a copy of these Terms and Conditions, your order and any email or written acknowledgement that we make.
11.2In these Terms and Conditions:
11.2.1references to "clauses" are to clauses of these Terms and Conditions;
11.2.2the headings are inserted for convenience only and shall not affect the interpretation or construction of these Terms and Conditions;
11.2.3words imparting the singular shall include the plural and vice versa. Words imparting a gender shall include the other gender and the neutral and references to persons shall include an individual, company, corporation, firm or partnership;
11.2.4references to "written" or in "writing" includes in electronic form; and
11.2.5references to "includes" or "including" or like words or expressions shall mean without limitation.
11.3No failure or delay by either party in exercising any right under the Contract shall operate as a waiver of such right or extend to or affect any other or subsequent event or impair any rights or remedies in respect of it or in any way modify or diminish your or our rights under the Contract.
11.4If any clause in these Terms and Conditions shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall in no way affect any other clause or part of any clause, all of which shall remain in full force and effect, so long as the Terms and Conditions shall be capable of continuing in effect without the unenforceable term.
11.5A person who is not a party to the Contract has no rights under any law to enforce any term of the Contract.
11.6The Contract and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law. Each of we and you irrevocably agree that the English courts shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Contract or its subject matter or formation (including non-contractual disputes or claims). All dealings, correspondence and contacts between us and you shall be made or conducted in the English language.
